Terms & Conditions

Alyssa Amy Medway (referred to as “Alyssa”) reserves the right to change or modify this Agreement, and any policy or guideline incorporated by reference at any time at her sole discretion.

 You (referred to as “the customer”) accept the Terms of Service, detailed herein, upon clicking the checkbox in Alyssa's checkout process.

 Any changes or modification will be posted by Alyssa Medway to https://www.alyssamedway.com/terms-conditions and become effective upon posting of the revisions on this page.

 You, the customer are responsible for regularly reviewing the Site to obtain timely notice of such changes or modifications. Your continued use of the Services following Alyssa Medway posting of any changes or modifications will constitute your acceptance of such changes or modifications. IF YOU DO NOT AGREE TO THE TERMS OF ANY MODIFICATION, DO NOT CONTINUE TO USE THE SERVICES AND IMMEDIATELY PROVIDE NOTICE OF CANCELLATION OF THIS AGREEMENT.

1. Use

Our work together will begin with the purchase of one of my three packages:

  1. 1 month package

  2. Seasonal package

  3. 1 year package

Alyssa Medway will discuss each customer’s individual grant writing needs at the start of each month to agree on output. Each month Alyssa Medway can either provide support completing 1 large grant, or approximately 3 small to medium sized grants as per her pricing page. Turnaround times are not guaranteed and will depend on the size and scope of each grant. Alyssa will strive to complete a first draft of grant applications and related tasks within 3 business days after receiving key organisational documents from the Customer requested during the onboarding stage.

2. Service description

All customers regardless of the package they have purchased will have access to the following services:

  • Grant scoping

  • Grant writing

  • Budget development

  • Project development – tailoring your project to best meet the funding requirements including by developing project plans, program logics and related documentation.

Once you have completed an initial call with Alyssa to determine whether her services are the right fit for your needs, Alyssa will send an invoice to initiate payment. Once payment has been received, your service will commence. Customers who have purchased a seasonal package can make a request to activate 1-month of support in the following ways:

-       Via email to contact@alyssamedway.com providing a list of grants in order of priority.

-       Verbally via a phone call or video conference.

Seasonal customers must activate a minimum of 1 month at a time.

Alyssa will work to complete the following number of grant applications per month for each customer depending on the package they have purchased and the size of each grant:

1-month

  • 1 large grant (worth upwards of $200,000/multi-year funding)

OR

  • Up to 3 small to medium sized grants (with a potential value of $200,000)

Seasonal Package (3-months of support)

  • 3 large grants (potential value of over $1 million+ /multi-year funding)

OR

  • Up to 9 small to medium grants (potential value of around $600,000+)

1 Year

  • 1 large grant per month (potential value of $200,000+ /multi-year funding)

OR

  • Up to 3 small to medium grants per month (potential value of around $200,000)

Alyssa will work on all grants discussed and negotiated with each customer and will endeavour to complete all grant writing requests by the closing date. Alyssa Medway will only start drafting any requested grant applications once she has received all the requested documentation including relevant organisational documents requested during the onboarding/service request process. Please do this as soon as possible to avoid any delays in the drafting process. Alyssa will follow up on any outstanding documentation, but the onus is on the customer to submit all requested forms and documentation as soon as possible.

3. Business day 

Alyssa Medway operates her services remotely from New Zealand. Alyssa will accommodate meetings according to the standard business week (Monday to Friday) within the relevant time zone of the customer where possible and within reason acknowledging that some customers may be outside of Australia. When completing grant applications Alyssa will work to deliver all drafts and final versions in accordance with the time zone specific to each funding opportunity.

Alyssa Medway will be unavailable on NSW public holidays and during the period of 23 December – 2 January (inclusive) annually. If a funding deadline arises during these dates, Alyssa will discuss this with you (the customer) in advance and will ensure that the grant application or proposal is developed and submitted prior to the 23rd of December.  

In the event that Alyssa becomes unwell or injured and will be unavailable for more than 5 business days, you will be notified as soon as possible, and she will extend the date of your next billing period to account for the number of business weeks affected.

4. Conditions/limitations

 While Alyssa Medway will complete each requested grant application to the best of her ability and will always strive to maintain high quality output she is not and will not be held responsible in the event that a funding submission is unsuccessful.

It is the responsibility of the customer to submit their own funding applications. While Alyssa Medway will provide all completed submissions in a suitable format, it will be the responsibility of the customer to submit the final application on their organisation’s behalf.

While Alyssa will do her best to recommend funding opportunities tailored to each organisation, not all opportunities that she recommends will be a perfect fit for each customer. The decision to apply for suggested opportunities will remain at the discretion of each customer.

5. Cancellation 

You may cancel your subscription with Alyssa Medway at any time before the end of the -current subscription period by emailing Alyssa at contact@alyssamedway.com. Upon cancellation, you will continue to have access to Alyssa Medway's services until the conclusion of your billing term.

6.  Money Back Guarantee 

If the customer is using Alyssa Medway's services for the first time they are entitled to an action-based, 30-day risk-free period to evaluate the quality of the service. This period begins on your date of purchase unless stated otherwise. You can request a refund by emailing contact@alyssamedway.com.

7. Payment

Payments are non-refundable and Alyssa does not provide refunds or credits for any partial subscription periods except as provided for in the Money Back Guarantee.  You further agree that, upon registering for the services through the Site, you authorize Alyssa Medway to charge your method of payment (e.g. credit card) for the fee on each anniversary of your registration date, based upon your billing frequency (e.g. monthly, quarterly, annually). Your subscription and access to the services provided via the site may be suspended in the event of non-payment of applicable fees. You represent and warrant to Alyssa Medway that such payment information is accurate and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur.  Alyssa Medway may change her fees from time to time by posting the changes on her website with 5 days prior notice, but with no advance notice required for temporary promotions or reductions in fees.   

8. Abuse of Service 

Alyssa Medway's services are designed for the reasonable use of non-profit organisations (NGOs), community minded businesses and/or individuals. Alyssa’s services are not meant to replace a full-time grant writer. If Alyssa finds a violation of her core values, or that you are abusing her services in any way, including using her services for illegal activities, she reserves the right to cancel your offer.

Alyssa Medway does not accept service requests outside of her scope of services and therefore reserves the right to decline or cancel a project that falls outside of the inclusions listed under the “service description” above.

 Alyssa’s output depends on many factors, namely the total request volume and complexity of each grant application. Alyssa will work on one grant at a time until completion before beginning the next. Alyssa will do her best to work with you to accommodate any priority items and your timelines. Your right to use Alyssa Medway' services shall terminate upon your breach of any term of this Agreement.

9. Intellectual property

The customer maintains the ownership rights of any finished products completed by Alyssa Medway and of any organisational documentation provided to Alyssa during the performance of the specific services requested by the customer.

10. Confidentiality

Alyssa Medway acknowledges that information disclosed to her by the customer in the course of performing her services is confidential and is the property, and/or a trade secret, of the customer. Alyssa Medway will not disclose, and will take reasonable steps to prevent the disclosure of, any confidential information to any person without the prior written consent of the customer. Alyssa Medway will use confidential information solely for the purpose of performing the services requested and not for any other purpose.

11. Limitation of liability 

Alyssa Medway will not be liable to you or any third party in any event for any loss (financially or otherwise) or any damages arising from or relating to this Agreement. You acknowledge and agree that your use of this service is at your own discretion and risk. Alyssa Medway holds no responsibility for unsuccessful grant bids or undesired outcomes as a result of any grant applications developed by her. Alyssa’s liability to the customer is governed solely by the Australian Consumer Law (“ACL”) (and any other similar or related consumer protection laws) and by this agreement. To the extent it is lawful, neither Party shall be liable to the other Party in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by that other Party of an indirect or consequential nature including without limitation any economic loss, data loss, loss of goodwill, or other loss of turnover, profits or business. Alyssa will comply with all laws, regulations, and other lawful requirements by any authority in Australia and other countries in which the services are being performed which affect or apply to Alyssa and her services.

12.  Dispute resolution & Governing law

 This Agreement shall be governed by and construed in accordance with the laws of the state of New South Wales (NSW), Australia, and the parties submit to the non-exclusive jurisdiction of the courts of NSW.

13. General

This Agreement constitutes the entire agreement between the parties with respect to the subject matter thereof and contains all of the representations, undertakings, warranties, covenants and agreements of the parties. This Agreement supersedes all prior negotiations, contracts, arrangements, understandings and agreements with respect to such subject matter. There are no representations, undertakings, warranties, covenants or agreements between the parties express or implied except as contained in this Agreement.
